  • New Zealand 4 Discovery Ltd does not itself provide or assist in the provision of any of the services or facilities (“the Services”) described in www.nz4discovery.nz (“the Site”) but acts only as the booking and payment agent of the provider of the Services (“the Supplier”). The provision of the Services is upon the terms and conditions specified by the Supplier.
  • New Zealand 4 Discovery Ltd shall not be liable for any loss, damage, injury, death, delay, inconvenience, cost or expense whatsoever, sustained, occasioned or incurred arising out of or in connection with the purchaser’s use of or participation in any service described on this Site of which New Zealand 4 Discovery Ltd is not the supplier unless it was caused by an act or omission on New Zealand 4 Discovery Ltd part.
  • New Zealand 4 Discovery Ltd will not be liable for any loss, cost, damage or expense in respect of or that results from: i. The act, default or omission of any third person or any other cause beyond New Zealand 4 Discovery Ltd control. ii. Any Services booked directly with a Supplier by the purchaser.
  • New Zealand 4 Discovery Ltd will not be liable for any loss of or damage to purchaser’s personal property, ill health, delays or travel disruptions, or changes in transport schedules or services unless caused by an act or omission on the part of New Zealand 4 Discovery Ltd
  • To the best of New Zealand 4 Discovery Ltd information and belief based on detail furnished by the Suppliers of the Services, New Zealand 4 Discovery Ltd understands the descriptions of the Services on this Site to be true and correct as at the time of going live on this Site and accepts no responsibility for changes to the Services that subsequently occur. New Zealand 4 Discovery Ltd makes no representation or warranty whatsoever as to the provision of any Service of which New Zealand 4 Discovery Ltd is not the supplier nor shall New Zealand 4 Discovery Ltd be liable to any person for the non-provision of any Service of which New Zealand 4 Discovery Ltd is not the supplier unless due to an act or omission on its part and the purchaser agrees that his/her sole recourse in such circumstances shall be against the supplier concerned.
  • Any claim arising out of the provision of services by New Zealand 4 Discovery Ltd will be governed by the laws of New Zealand. Any claim against the Supplier is subject to the terms of the contract for the provision of the Service concerned and maybe governed by the laws of another country.
  • International or Domestic carriage by air in conjunction with any of the Services herein is upon and subject to the Conditions of Carriage of the air carriers concerned and applicable international conventions which may limit their liability for injury or death and loss of or damage to baggage.
  • No employee or agent of New Zealand 4 Discovery Ltd has any authority to amend, cancel or otherwise alter the conditions on this Site.
  • If any portion of the above conditions is inconsistent with or breaches any applicable law it shall be void and of no effect.
  • Where the purchaser requires or holds himself/herself out as acquiring New Zealand 4 Discovery Ltd services or any of the Services herein for the purpose of a business the provisions of New Zealand Consumer Guarantees Act 1993 will not apply to the supply of any of those services and New Zealand 4 Discovery Ltd will not be liable for any resulting loss or damage including any consequential loss or damage howsoever caused
